Philip D. Phillips is Board Certified, Family Law -- Texas Board of Legal Specialization, in practice since 1979.  He exclusively practices Family Law and currently limits his practice to the preparation of Qualified Domestic Relations Orders (QDRO) used in dividing retirement benefits.  This service is performed for a flat fee of $400 per QDRO (or other division order) and although primarily done for other attorneys, it can also be done for pro se parties under certain circumstances.  For more information, please click on the "QDRO Preparation" menu item to the left.

We do not prepare QDROs for out-of-state cases.

The approximate time-line for the QDRO process is as follows:

1.    Once I have all required info and fee, my usual turn-around time to prepare the QDRO is 2-3 business days.  The QDRO will be emailed to the attorney.

2.    The attorney must get the divorce court Judge to sign the QDRO.  This could take several days for an agreed QDRO to many months for a contested case.  The county, particular court and other factors can also affect the time it takes the attorney to get the QDRO signed.  The parties should contact his or her divorce attorney for more specific info on this time element.

3.    Once the attorney returns a certified copy of the QDRO to me, my office will forward to the Plan Administrator, usually within 1-2 days of our receipt.  Most are mailed by certified mail, which some third-party administrators are now allowing submissions by fax, email or uploading to a web site.

4.    Average processing time for the Plan Administrator to review the QDRO is about 90 days, however, this is only an average.  This processing time can be longer.

5.    The Plan Administrator will usually notify the parties, attorneys and my office of the result of the review by letter.  Some are now sending emails.  The Plan will provide the parties with contact information and, sometimes, forms for completion.  I have nothing to do with the actual transfer of the money.  That is handled directly between the Plan and the parties.
